Surrogacy Laws in Tabasco, Mexico


All the intended parents who travel to Tabasco will receive the same legal treatment that US parents receive in accordance to their parental rights to a child born through surrogacy establishments.

92ND ARTICLE – TABASCO LAW (TACASCO’S CIVIL CODE)
When a child is born with the participation of a gestational substitute mother, parenthood is presumed by the contracting parent. This happens when the parent registers the child’s birth, action which implies the parenthood acceptance.

347TH ARTICLE – TABASCO LAW (TACASCO’S CIVIL CODE)
If the reproductive process involves a second woman, the contracting mother, whether she provides the egg or not, is presumed as the legal mother.

Also, when the gestational substitute mother is not the child’s biological mother (the child is born through an embryo transfer process), the contracting mother is considered the child’s legal mother.

In order to join a surrogacy program, a contract should be signed by both parties. A legal advisor will assist the intended parents in formulating agreements that have to be signed prior to moving forward with the medical stages. After the intended parents and the surrogate agree upon working together, both of them will be represented by an attorney who is specialized in third-party reproduction.

The law in Tabasco requires a surrogacy contract recognizing the intended parents as legal parents. The surrogate mother’s name won’t appear on the birth certificate. The Mexican legal process is usually easy and problem-free, but still, future parents must have a genetic link to the child in order to obtain the baby’s citizenship in their home country. If the parents have no genetic link to the child, they should consult an independent legal consul specialized in family and immigration law.

Please note that:

The Surrogacy Program in Mexico is currently under review by the Mexican government, which is decided to suspend until further notice the authorization of passports, (except in cases where the country´s parents grant them citizenship) to those babies born to these programs. It is anticipated that this process will delay more time.
